I. Administrator danych osobowych

II. Cel przetwarzania danych osobowych oraz podstawa prawna

• Dane osobowe będą przetwarzane zgodnie z Rozporządzeniem Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (dalej „RODO”) w celu:
  • realizacji usług lub do podjęcia działań na żądanie osoby, której dane dotyczą, przed zawarciem umowy (art. 6 ust. 1 lit. b RODO) – do czasu zrealizowania usługi lub przez czas jej trwania,
  • obrony przed roszczeniami (art. 6 ust. 1 lit. f RODO) – przez okres przedawnienia roszczeń wskazany we właściwych przepisach prawa,
  • wypełnienia obowiązków prawnych ciążących na Muzeum Karykatury, np. wystawianie i przechowywanie faktur oraz innych dokumentów księgowych, sporządzenie informacji podatkowej, dokumentowanie i prowadzenie rozliczeń należności publicznoprawnych (art. 6 ust. 1 lit. c RODO) – przez okres wskazany we właściwych przepisach prawa,
  • marketingu bezpośredniego produktów lub usług Muzeum Karykatury – co wynika z prawnie uzasadnionego interesu Muzeum Karykatury, (art. 6 ust. 1 lit. f) RODO w zw. z motywem 47 RODO) - do czasu wniesienia sprzeciwu,
  • tworzenia zestawień, statystyk i/lub analiz na potrzeby wewnętrzne Muzeum Karykatury - (art. 6 ust. 1 lit. f RODO) – do czasu uwzględnienia przez Muzeum Karykatury uzasadnionego sprzeciwu albo wniesienia sprzeciwu,
  • przekazywania treści marketingowych drogą elektroniczną przez Administratora (art. 6 ust. 1 lit. a RODO w zw. z art. 172 ustawy z dnia 16 lipca 2004 r. - Prawo telekomunikacyjne i art. 10 ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną) – w przypadku wyrażenia osobnej zgody, do czasu jej cofnięcia. Cofnięcie zgody może nastąpić w każdym momencie, lecz nie ma ono wpływu na przetwarzanie danych dokonane przed takim cofnięciem.
• Dane osobowe pozyskane od osoby, której dane dotyczą podawane są dobrowolnie. Odmowa podania danych osobowych może skutkować niemożliwością świadczenia danej usługi.

III. Komu przekazujemy dane osobowe

Odbiorcami danych mogą być podmioty lub osoby współpracujące z Administratorem w zakresie realizowania celów, wskazanych w pkt. II powyżej.

W przypadku korzystania przez Administratora danych z narzędzi podmiotów, które mają swoją siedzibę poza Europejskim Obszarem Gospodarczym (dalej: EOG) lub które mogą przechowywać dane poza EOG, (Pani/Pana dane osobowe nie będą przekazywane do organizacji międzynarodowych), Administrator zastosuje wszelkie dostępne prawnie środki ochrony (np. przewidziane w art. 46 RODO) w celu zabezpieczenia takiego przekazania danych. Do przekazywania danych poza EOG może dochodzić na podstawie wyjątków przewidzianych w art. 49 RODO, o ile mają zastosowanie warunki określone w tym artykule. IV. Państwa uprawnienia

• Ma Pan/i prawo dostępu do treści swoich danych oraz do ich sprostowania, usunięcia, ograniczenia przetwarzania, przenoszenia danych (o ile dotyczy).
• Dane osobowe nie będą przetwarzane w sposób zautomatyzowany, w tym również w formie profilowania tzn. żadne decyzje wywołujące wobec osoby skutki prawne lub w podobny sposób na nią istotnie wpływające nie będą oparte wyłącznie na automatycznym przetwarzaniu danych osobowych i nie wiążą się z taką automatycznie podejmowaną decyzją.

V. Sprzeciw

Oprócz Państwa uprawnień wskazanych w pkt. IV powyżej, ma Pan/i także prawo wniesienia sprzeciwu wobec przetwarzania danych osobowych z przyczyn związanych z Pani/Pana szczególną sytuacją, a także prawo wniesienia sprzeciwu wobec przetwarzania danych w celach marketingu bezpośredniego przez Muzeum Karykatury.

VI. Skarga

Ma Pan/i prawo do wniesienia skargi do organu nadzorczego - Prezesa Urzędu Ochrony Danych Osobowych, gdy uzna Pan/i, iż przetwarzanie danych osobowych Pana/Pani dotyczących jest niezgodne z prawem.

I. Personal data controller

II. Purpose of personal data processing and legal basis

• Personal data will be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the "GDPR") in order to/for:
  • provide services or to take steps at the request of the data subject prior to entering into a contract [Article 6(1)(b) of the GDPR] – until the service is provided or for the duration of the service,
  • defence against claims [Article 6(1)(f) of the GDPR] – for the period of limitation of claims indicated in the relevant provisions of law,
  • fulfil legal obligations incumbent on the Museum of Caricature, e.g. issuance and storing invoices and other accounting documents, preparing tax information, documenting and keeping settlements of public law receivables [Article 6(1)(c) of the GDPR] – for the period specified in the relevant provisions of law,
  • direct marketing of the Museum of Caricature products or services – resulting from the legitimate interest of the Museum of Caricature [Article 6(1)(f) of the GDPR in connection with recital 47 of the GDPR] – until an objection is raised,
  • creating summaries, statistics and/or analyses for the internal needs of the Museum of Caricature [Article 6(1)(f) of the GDPR] – until the Museum of Caricature takes into account a justified objection or until objection is raised,
  • transmission of marketing content by electronic means by the Controller [Article 6(1)(a) of the GDPR in connection with Article 172 of the Act of 16 July 2004 – Telecommunications Law and Article 10 of the Act of 18 July 2002 on the provision of electronic services] – in case of giving a separate consent, until its withdrawal. The consent may be withdrawn at any time, without affecting the processing based on consent before such withdrawal.
• Personal data obtained directly from the data subject are provided voluntarily. Refusal to provide personal data may result in the inability to provide a given service.

III. To whom we transfer personal data

• The data recipients may be entities or persons cooperating with the Controller in the implementation of the purposes indicated in point II above.
• If the Controller uses tools of entities with their registered office outside the European Economic Area (hereinafter: EEA) or which may store the data outside the EEA (your personal data will not be transferred to international organisations), the Controller will apply all legally available protection measures (e.g. provided for in Article 46 of the GDPR) to secure such data transfer. Data transfers outside the EEA may take place on the basis of the exceptions provided for in Article 49 of the GDPR, provided that the conditions set out in this Article apply. IV. Your rights

• You have the right to access your data and to rectify, delete, limit processing, transfer data (if applicable).
• Personal data will not be processed in an automated manner, including in the form of profiling, i.e. no decisions that have legal effects on a person or significantly affect them in a similar way will be based solely on automated processing of personal data and are not related to such an automatically made decision.

V. Objection

In addition to your rights indicated in point IV above, you also have the right to object to the processing of personal data for reasons related to your particular situation, as well as the right to object to the processing of data for direct marketing purposes by the Museum of Caricature.

VI. The complaint

You have the right to lodge a complaint with the supervisory authority – the President of the Office for Personal Data Protection, if you believe that the processing of your personal data is unlawful.
